A long-paused mural project at the Cozy Inn is moving again as the restaurant’s legal dispute with the City of Salina continues through federal court.

The mural, painted on the side of the longtime downtown burger restaurant, became the center of a free-speech case after city officials determined the artwork should be treated as a sign under local code. The city’s position was that the image and wording were tied closely enough to the business to fall under sign regulations.

The restaurant’s owner challenged that decision, arguing the mural was protected artistic expression and should not be restricted based on what it depicted or said.

How the dispute started

The mural was first started in late 2023 but was stopped shortly after work began. The issue was not whether the building could have artwork on it, but whether the content of the mural made it a regulated sign.

That distinction became the core of the lawsuit. If treated as a sign, the mural would be subject to city limits on size and placement. If treated as art, the restaurant argued it should receive broader First Amendment protection.

Federal ruling and appeal

A federal judge later sided with the Cozy Inn on key constitutional claims, finding that the city’s enforcement depended on the message of the mural. The court’s ruling allowed the project to move forward.

The case, however, is not finished. The City of Salina has appealed, meaning the legal fight over the city’s sign regulations and how they apply to murals is still ongoing.

Why the case matters

The dispute has drawn attention beyond Salina because it raises a broader question for local governments: when does a mural on a business become advertising, and when is it protected expression?

That question matters for cities trying to regulate signs and for business owners or artists who want to place creative work on commercial buildings.

For now, the mural work has resumed, but the final outcome of the case could still affect how Salina handles similar artwork in the future.
