Salina woman gets probation after attempted rape charge is amended to a misdemeanor

A Salina woman who was charged last month with attempted rape and robbery was sentenced Thursday, Oct. 22, and granted probation after pleading no contest to two misdemeanors, according to Saline County District Court records.

Christine Kaylin Musgrove pleaded no contest to assault of a law enforcement officer and lewd and lascivious behavior at what had been scheduled as her preliminary hearing before District Judge Jared B. Johnson. A no-contest plea is not an admission of guilt, but it results in a conviction the same way a guilty plea does. The remaining charges, including felony robbery and felony interference with law enforcement, were dismissed.

The original complaint, filed Sept. 28, charged Musgrove with six counts. The most serious was attempted rape, a severity level 3 person felony that carried a possible prison term of 55 to 247 months. An amended complaint filed at the Oct. 22 hearing changed the attempted rape count to lewd and lascivious behavior, a class B misdemeanor.

The charges stemmed from a Sept. 26 incident. Police said at the time that Musgrove was arrested after a reported assault in the 600 block of South Broadway.

Earlier coverage

In the amended complaint, prosecutors alleged that Musgrove put a uniformed or properly identified Salina police officer in reasonable fear of immediate bodily harm while the officer was on duty. They also alleged that she publicly engaged in a sex act, knowing or reasonably expecting that others could see it, in the presence of another person who was at least 16 years old.

Johnson sentenced Musgrove to 12 months in jail on the assault count and six months in jail on the lewd and lascivious behavior count, to run at the same time, and granted her 12 months of probation supervised by court services. A written sentencing order had not been filed in the case as of Oct. 22.

As conditions of probation, Musgrove must follow standard probation terms, complete an alcohol and drug evaluation and a mental health intake within 30 days, and follow all recommendations from those evaluations. She is also ordered to have no contact with the victims in the case, except for contact with the officer during an emergency.

She was ordered to pay court costs, court services and drug-testing fees, and a $100 application fee for her court-appointed attorney. The court waived attorney fees.

Musgrove was represented by court-appointed attorney Jeffery Adam. Assistant Saline County Attorney William D. Strommen filed the amended complaint. Bond had been set at $100,050 at her first court appearance on Sept. 29.

No further hearings were scheduled in the case as of Thursday afternoon.
